1.         General

The owner of the Website is DIY Travel Limited, an Irish company with registration number  455425 and having its registered office at 153 Glenageary Park, Glenageary, County Dublin (the “Company”). By using the Website, you agree to be legally bound by and act in accordance with these terms and conditions and by all other applicable provisions. If you disagree with any of these terms and conditions and/or with any of the other applicable provisions, you are not permitted to and agree not to use the website.

In using the Website, you warrant that:

  • you are 18 years old or older;
  • you have the legal authority to create a binding agreement; and
  • you will only make genuine bookings for you or for another person for whom you are legally authorised to act .

 

2.         Definitions

In these terms and conditions, unless the context requires otherwise, the following expressions shall have the following meanings:

“EEA”                                    European Economic Area;

“Member”                           an individual who has registered with the Website;

“Personal Information”    any information, recorded in any form, about an identified individual or an individual whose identity may be inferred from the information. This includes, for example, the individual’s name, e-mail address, mailing address, telephone number, billing and account information and other information incidental to providing the Products or Services (including information about individuals travelling with that individual);

“Products or Services”    hotel accommodation, tours, attractions and other items made available by the Company from the Website; and

“Session Date”                   usage information, such as the type of internet browser and operating system that an individual uses, the domain name of the site from which the individual came, the date, time and duration of the visit, number of visits , average time spent on the individual’s site, domain name of the individual and number of cookies accumulated.

 

3.         Permitted Use

You are not permitted to use the Website other than for the following private non – commercial purposes:

  • viewing the Website;
  • making bookings;
  • reviewing and/ or changing bookings;
  • transferring to other websites though links provided on the Website; and
  • making use of other facilities  that may be provided on the Website.

Use of the Website for any purpose other than the aforementioned private, non – commercial purposes is prohibited. In particular, use of any automated system or software to extract data from the Website for display on any other website (“screen scraping”) is prohibited. In addition, the Website may not be used without the Company’s prior written consent for offering the Products or Services for sale to others purchasing the Products or Services for resale to others, or the like.

Furthermore, you must not use the Website for any activities which breach any laws, infringe any party's rights, or breach any standards, content requirements or codes promulgated by any relevant authority. You indemnify us from and against all actions, claims, suits, demands, liabilities, costs or expenses arising out of or in any way connected to use of the Website by you or any other person.

Unless otherwise provided within these terms and conditions, or unless specific applicable law requires us to allow you to do so, you may not do any of the following without our prior written consent:

use any robot, spider, scraper, other automatic device or manual process for any purpose;

  • use the Website other than to make legitimate reservations or purchases;
  • use the Website to make any false, fraudulent or speculative reservation or any reservation in anticipation of demand;
  • imply in any fashion that the Company is endorsing your products or services;
  • place false or misleading information on the Website;
  • post or transmit any unlawful, threatening, libelous, defamatory, obscene, indecent, inflammatory, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law or for any other purpose that is unlawful or prohibited by these terms and conditions;
  • use or access the Website in any way that, in our reasonable judgment, adversely affects the performance or function of the Website, or any other computer systems or networks used by us or  other website users;
  • upload or transmit to the Website or use any device, software or routine that contains viruses, Trojan horses, worms, time bombs or other computer programming routines that may damage, interfere or attempt to interfere with or intercept  the normal operation of the Website, or appropriate the Website or any system, or take any action that imposes an unreasonable load on our computer equipment, or that infringes upon the rights of a third party;
  • use any device, software or routine that interferes or attempts to interfere with the normal operation of the Website or disguises the origin of the information transmitted through the Website;
  • violate the restrictions in any robot exclusion headers on the website or bypass or circumvent other measures employed to prevent or limit access to the Website;
  • use the Website or its contents for any commercial purpose;
  • take any action that will or potentially put pressure on the Website infrastructure;
  • deep-link to any portion of the Website for any purpose; or
  • utilise parts of the Website infrastructure into any other website without our prior written authorization.

 

4.         Intellectual property

All copyright and other intellectual property rights in any material, including html code, text, photographs or other images displayed on the Website, are either owned by us or have been licensed by the owner for our use. All rights are acknowledged. If you wish to use any of the information or material displayed on the Website, you must first obtain our written permission, or that of the owner of the rights to the material, as the case may be. You must not modify, copy, transmit, display, perform, publish, licence or create derivative works from any information or software accessed by means of the service. Where copying or transmission is expressly permitted, you must not change or delete any author attribution or copyright notice. Any unpermitted use and/or reproduction of the information of the information, date, materials , or of the colour scheme or layout of the website, without the prior written consent of the Company, is prohibited and will constitute a breach of these terms and conditions and may infringe the Company’s intellectual property rights. The Company reserves the right to take such steps as it considers necessary, including issuing legal proceedings without further notice to you in relation to any unauthorised use of the Website.

Reference on the Website to any products, services, processes, trade names, trade marks or other information of third parties does not imply or constitute an endorsement, sponsorship or recommendation to you by us. Links to other websites not operated by us are solely for your convenience. We are not responsible for any products, services, processes, trade names, trade marks or other information provided by third parties. Our inclusion of hyperlinks to such websites does not imply any endorsement of the material on such websites or any association with their operators.

 

5.         Accuracy of information on Website and availability

The information on the Website is posted in good faith and updated regularly, but we cannot guarantee its completeness and accuracy. Images and description materials on hotels and services are drawn from information provided by the hotels or suppliers. We cannot and have not checked the accuracy of all information provided by providers, including weather and currency conversion rates. Particular features or facilities in hotel description form part of the hotel standard offering and their availability cannot be guaranteed unless specifically requested by you and confirmed by us in writing. We do not accept any liability to you or any third party for any error or omission on the Website. We may change, update or delete any information on the Website without prior notice. We do not warrant that the Website will be uninterrupted, error free or that any information or other material accessible from this website is free of viruses or other harmful components.

We do not make any representation about the suitability of information, products and services on the Website for any purpose. The Website is provided on an "as is" and on an "as available" basis. You assume all responsibility and risk for use of the Website. We will not be responsible for any errors, omissions or misleading information and we disclaim, to the maximum extent permitted by law, all implied warranties in connection with such information.

All photographs used on the Website are for the purposes of illustration only and should not be taken to be literal representations of actual facilities, accommodations or services offered, unless otherwise advised by us.

In no event shall we be liable for any, injury, loss, claim, damage or any direct, incidental, special, consequential damages or economic loss, including but not limited to loss of profits or savings, arising out of or in any way connected with the use of any data or information displayed on the Website.

 

6.         General Booking Terms

You agree to book only genuine bookings where a specific traveller exists who is ready to pay for such booking.

Full payment is due on all online bookings. Where the purchase is made by telephone for a group of nine or more persons, we accept a booking deposit of 20% of the total amount due upon booking with the full balance due six weeks before the group travels, unless otherwise agreed with us.

Any booking placed/made by you, whether through the Website or otherwise, shall be deemed an offer by you to purchase the relevant hotel booking or other holiday arrangement and shall be subject to these terms and conditions.
If you make a booking on behalf of a group you shall accept these terms and conditions on behalf of all members of that group and you are responsible for all payment due from that group.

Group booking may take up to 48 hours to confirm.

When you use the Website to make a booking, you will need to provide us with credit or debit card details in order to cover the full cost of the Products or Services booked. You authorise us or an authorised third party to take full payment for the total amount of your purchase. Please note that you may be required to present a credit card at the time of check-in, to provide confirmation of authorised card use or to secure any additional charges.

If your payment method is declined, we will make contact with you using the contact details provided by you. If we are unable to make contact or if payment is outstanding for any other unrelated reservations made you the booking will be cancelled.

The price of each Product or Service is regularly reviewed and may go up or down. Promotional or discounted offers on the Website are provided at our discretion. All offers are subject to availability and may be withdrawn at any time. 

We will charge you for any additional handling fees incurred by us in respect of payment through a debit or credit card. All such fees will be notified to you when making your booking.

It is your responsibility to ensure that all details of the booking are correct before purchasing and that any information which is given to you by us is passed on to all members of your party. Any information which we give to you shall be deemed as given to each and every party member for whom you are making or have made a booking.

 

7.         Reservations

Upon receipt of an invoice and voucher in respect of a booking made on the Website, it is imperative that you check and confirm all reservation details. The Company must be notified of any discrepancies within 24 hours of the discrepancy having been made. Outside of this 24 hour period, we cannot rectify the booking and any subsequent rectification becomes a chargeable amendment. Please see Amendments section.

The voucher received in respect of a booking on the Website must be presented to the hotel as this confirms both proof of booking and proof of pre-payment. Payment for extras not specified on the voucher, such as meals, drinks, mini-bar, car parking etc must be made directly to the hotel. Some hotels may require a credit card imprint on arrival and is taken to guarantee payment of incidental charges.

 

8.         Star Ratings

Star ratings given to hotels on the Website are provided by our suppliers, having inspected them.
 
Star ratings are used to symbolise the overall quality, level of service, food standard and range of facilities available in any given hotel property. They are not a guarantee or warranty of any kind by the Company.

We do not endorse or recommend any particular hotel, nor will be necessarily aware of any building work inside or outside the hotel.

 

9.         Explanation of room types and child policy

Single room:            Accommodation for one adult in a room with one single bed or any one double bed.

Twin room:              Accommodation for two adults in a room with two beds. Bed sizes for this room type are usually "queen" in American hotels.

Twin room for         Accommodation for one adult in a room with one
sole use:                    or two beds. This room type is suitable for accommodation for one person only.

Double room:          Accommodation for two adults in a room with one bed. Alternatively two beds made up as one.

Double room:          Accommodation for one adult in a room with one bed for sole use. This is billed as if occupied by two persons.  

Triple room:             Accommodation for three adults in a room with tow or three beds. Bed sizes and arrangements may vary. A triple room does not guarantee three separate beds. One bed may be a roll – way bed. May result in a room of restricted space.

Quadruple:               Accommodation for four adults in a room with two, three or four beds. Arrangement of beds may vary considerably. Please see property description to clarify accommodation type.

Child Policy:            Child discounts may be available for children under 12 years sharing a room with 2 adults (some child discounts are bookable online). In some hotels no additional bedding is provided for a child where the child is either free or at a reduced price and breakfast may be charged for the child on departure.

Cot/cradle or crib: Suitable for a child under the age of 2 years. Cots are always on request with the hotel and cannot be guaranteed.

No Facilities           These are rooms with no facilities. They do not
Rooms:                     have en-suite bathroom or W.C.

                                                 
Self-catering:           The property may provide facilities to cook on the premises. Please note the facilities vary from accommodation to accommodation and may be limited. For more details please speak to one of our reservations staff.

BB:                             Bed and breakfast.

HB:                             Half Board - breakfast and evening meal included.

FB:                             Full board - breakfast, lunch and evening meal.

AI:                             All meals and beverages. Terms and conditions apply depending on the hotel. Please speak to one of our reservations staff who will be able to give you a breakdown of what is included.

 

10.       Hotel facilities

Please read the detailed description of the hotel for other hotel policies applicable to your stay.

Please note that the hotels booked by us for you are not exclusive to us. We are not responsible for any limitation in facilities because of other hotel guests or their activities. We do not take responsibility for hotel content (including images, facility listings, etc.) displayed on the Website. Hotels may change facilities and property features without prior notice to us and it is your responsibility to confirm facilities directly with the hotel at the time of travel.

 

11.       Unavailability

Where we are unable to confirm the initial requested accommodation, we will call you to inform you of the details of alternative accommodation (if any). At that time you will have the option to accept the alternative accommodation or get a refund of the total monies paid to us by you for your original booking.

In the event of a confirmed booking becoming unavailable, we will endeavour to offer an alternative hotel at an equivalent standard and price in the same general location. If no such alternative is available we shall refund the cost of your original booking to you. Otherwise you may exercise your right of cancellation. We will also endeavour to contact you in advance and advise you of this unavailability. Where it is not possible to contact you in advance we shall endeavour to ensure that the relevant hotel looks after any change of accommodation as quickly and efficiently as possible.

In the unlikely event that the hotel cannot provide the booked accommodation, you accept that the hotel’s responsibility is to find an alternative of at least a similar standard and to provide transportation as appropriate to the alternative hotel. We shall have no liability in respect of any costs, losses or damages arising out of or in connection with a relocation of accommodation, since such relocation is outside of our control.

 

12.       Local Taxes Not Included in Hotel Cost

Please note that there may be taxes levied abroad but not paid at the point of purchase that are payable in relation to your hotel booking e.g. local taxes, sales tax etc. Any local taxes will be payable by you directly to the hotel at the time of check in/checkout.

 

13.       Our right to cancel and amend prices

We reserve the right to cancel your hotel booking if we have made a mistake in relation to the price of your stay. We will ensure that we notify you of such mistakes within a week of your booking, provided your stay has not started yet. We reserve the right to amend prices due to currency fluctuations. However, once payment in received from you, the price is fixed regardless of subsequent currency fluctuations.

 

14.       Cancellations

All bookings with Special Conditions will be charged at 100% of the purchase price.

All bookings which are cancelled within 0-5 days before arrival will be charged at 100% of the purchase price.

All bookings which are cancelled before 5 days of arrival will be charged at 25% of the purchase price.

Where cancellation applies to multiple room bookings, the cancellation fees shall apply for each room booked, whether in one or more hotels.

Cancellation charges will also apply to any sightseeing tours or attractions booked. Any changes or modifications to sightseeing tour or attraction bookings will be treated as cancellations and will incur cancellation charges. All sightseeing tours and attractions booked are non-refundable.

All bookings for one night only are subject to a 100% cancellation fee, whenever cancelled.

All New York bookings made for accommodation or sightseeing tours or attractions from 1 November until 31 December are subject to a 100% cancellation charge, whenever cancelled.

All cancellations must be received in writing either by e-mailing info@cityhotels.ie, faxing +353 1 507 8560 or alternatively by post to Cityhotels.ie, Suite 306 Media Cube, Kill Avenue, Dun Laoghaire, Co.Dublin.

All cancellations must be received by 1500 hrs GMT on the third day before arrival. Please note that the Company is not open on Sundays and Irish public holidays for or after 17:30 hrs GMT on any week day. Cancellations during such periods should be sent direct to the hotel with a copy to the Company by e-mail or fax.

If you leave your accommodation before the expiry of your stay, you are not entitled to any refunds as this is classed as a cancellation.

 

15.       Amendments

Amendments of bookings can be made at a charge of €20 per person.

Amendments within three days of arrival are not permitted and if you fail to keep the booking it will be classed as a cancellation with a 100% cancellation fee.

All amendments must be received in writing either by e-mailing info@cityhotels.ie, faxing +353 1 507 8560 or alternatively by post to Cityhotels.ie, Suite 306 Media Cube, Kill Avenue, Dun Laoghaire, Co.Dublin.

All amendments must be received by 1500 hrs GMT on the third day before arrival. Please note that the Company is not open on Sundays and Irish public holidays for or after 17:30 hrs GMT on any week day. Cancellations during such periods should be sent direct to the hotel with a copy to the Company by e-mail or fax.

 

16.       Remarks / Requests

Client requests are not guaranteed and are purely at the discretion of the hotel. The Company is in no way responsible for requests that have not been honored by the hotel.

The rooms of non-arrivals are usually automatically released the following morning. Please contact the Company or the hotel directly if a booked room should be held.

 

17.       Customer Complaints

If a customer is dissatisfied with any aspect of his/her hotel, this must be brought to the attention of the hotel management immediately and the hotel management must be given adequate opportunity to rectify the issue. If the hotel cannot resolve matters to the customer's satisfaction, the Company must also be contacted at the earliest opportunity. During a dispute with a hotel, clients who leave their accommodation before the duration of their stay are not guaranteed any refunds and any subsequent new bookings with other hotels  is at the clients’ expense.

If having taken the above action the customer is still dissatisfied, complaints must be received in writing by the Company accompanied by any relevant documentation. All written complaints must be received within 30 days of the end of your stay in the hotel as otherwise the Company Hotels cannot investigate your complaint.

Complaint investigations may take between six to twelve weeks to resolve.

The Company has no control over the investigation and response time of a supplier.

 

18.       Your behaviour

It is your responsibility to ensure that you and the members of your group do not behave in a way which is inappropriate or causes danger, distress, offence or damage to others or which risks damage to property belonging to others whilst on your trip.

If, in our reasonable opinion or that of our suppliers, your behaviour is inappropriate and causes danger, distress, offence, or damage to others, or risks damage to property belonging to others, we and/or our suppliers may take appropriate action in order to ensure the safety and comfort of our customers and their property and that of our suppliers, in which case our and our supplier's responsibility to you will cease immediately and you will not be eligible for any refunds, payments of compensation and/or any reimbursement of any cost or expenses you may incur as a result of such termination. Further, you will be liable to reimburse us for any expenses we incur necessarily as a result our required actions.

 

19.       Special assistance

If you are disabled or incapacitated or of limited mobility or require special assistance for any reason, we require that you notify us at the time of making your booking. If these requirements change before your trip you must inform us. We will not subsequently be liable to you for any losses you may incur in the event that we or our suppliers are unable to accommodate your requirements.

 

20.       Weather

We cannot be held responsible for any disruption to your trip due to bad or unusual weather conditions.

 

21.       Special requests

Please advise us of any special requests and we will pass these on to the relevant supplier. However, we cannot guarantee your special request as we do not have any direct control over the manner in which the services are provided.

 

22.       Vouchers

All vouchers issued by us are subject to these terms and conditions.

 

23.       Coupons

All coupons provided on the Website are provided by the coupon providers and are subject to the coupon provider’s terms and conditions. The Company takes no responsibility for the validity of the coupons or the accuracy of the information contained on them.

 

24.       Calls may be recorded for training purposes

We reserve the right to randomly record telephone calls to ensure that our customer service is constantly reviewed.

 

25.       Privacy Policy

Your privacy is very important to us. This Privacy Policy describes the principles and practices that apply to Personal Information (defined below) collected from you on our Website, in telephone or email communications, or in competitions or prizedraws.

 

25.1    Summary of Privacy Policy

  • We will not collect Personal Information without your knowledge and permission.
  • We will not knowingly disclose your Personal Information to third parties, except as provided in this Privacy Policy.
  • We will allow you to view, correct or remove your Personal Information.
  • We will take reasonable steps to protect the security of the Personal Information we collect from you.

The remainder of this policy describes our Personal Information handling practices in detail.

 

25.2    Consent

By submitting personal information to us, and/or by using our website, you agree that we may collect, use and disclose such personal information in accordance with this privacy policy and as permitted or required by law.
If you do not agree with these terms, do not provide any Personal Information to us. If you refuse or withdraw your consent, or if you choose not to provide us with any required Personal Information, we may not be able to provide you with the Products or Services.

25.3    Minors

Minors (as defined under the laws of their jurisdiction or residence) are not eligible to register for, use, or purchase the Products or Services available on Website. We do not knowingly collect Personal Information from any minor, and will not use this information if we discover that it has been provided by a minor.

 

25.4    Other Travellers or Contacts

If you provide us with contact information of a third party at any time, you must make sure that you have the right to do so. By providing the Personal Information of another traveller, you represent that you have all necessary authority and/or have obtained all necessary consents from such person to enable us to collect, use and disclose his or her Personal Information as set forth in this Privacy Policy. 

 

25.5.   What Personal Information we collect

We collect only such information as necessary to provide the Products and Services to you.

 

25.6    When you are just visiting

You can visit certain areas of the Website without revealing who you are when signing-in. When you visit the Website, we collect Session Data through cookies and pixel tags. A cookie is a small text file that our computer sends to your computer and that your computer sends back to us each time you make a request from the Website. A pixel tag is a small graphic image similar to a cookie.

 

25.7    When you register as a Member

If you register with us as a Member, we collect Personal Information that is necessary to provide the Products or Services. We require that you provide your name and email address. You also need to choose a password, which will be required to gain access to portions of our Website reserved for Member use.

 

25.8    When you Purchase Products or Services as a Member

When you Purchase Products or Services from our Website as a Member, you must provide payment or other necessary information.

 

25.9    When you Purchase Products or Services for a third party

When you Purchase Products or Services for a third party, we will collect that third party's name and contact information, and other information as required so that we can complete the booking.

 

25.10  When you participate in competitions and prizedraws

We may offer you the chance to win a variety of travel related prizes by sponsoring competitions and prizedraws. If you choose to participate, we will collect Personal Information, such as your full name, email address, or mailing address. If a third party administers the contest, your participation may be subject to that other party's terms and conditions, and privacy policy. Detailed information about these terms will be provided on the applicable form you will be asked to fill out. You should carefully review these third parties’ terms and conditions. If participate in a competition, promotions or prizedraw, we will use your personal information to notify you if you were. You may send you additional communications only if you have specifically requested to receive our newsletters, e-mails, personalised offers or other promotional materials when following out the promotion or contest form.

 

25.11  When we advertise on third party sites

When you visit a site on which we advertise, and click through our advertisement, we may place cookies on your computer or use pixel tags. The information that we collect through this technology is not personally identifiable.

 

25.12  When you call or write to our Customer Service

When you call or write to our Customer Service, we collect contact information (name, phone number, mailing address or email address) and information about the relevant purchase as necessary to assist you. For example, if you call for assistance with a pre-existing purchase, or to make a purchase, we may request your contact and billing information.

 

25.13  When we send emails or e-newsletters

When we send emails, e-newsletters, or when you forward a promotion or search results to a third party, using the "Send to a Friend" feature, we may insert a pixel in the email.

 

25.14. How we use the information we collect

We use Personal Information in order to provide and enhance the Products or Services:

  • to record your travel preferences, to make reservations or acquire travel insurance on your behalf, or to communicate with you about your travel plans;
  • to issue invoices, administer accounts, collect and process payments;
  • to provide tips or guidance on how to use the Website, inform you of new features on our Website, or provide other information that may be of interest to users;
  • to personalize the service we provide to you, tailor your experience at our Website to your interests and make more appropriate travel recommendations;
  • to send you emails, e-newsletters, personalized offers via direct messaging or other communications about our services, if you have subscribed to receive this information or you have not advised us that you do not wish to receive such communications;
  • to manage the Website, diagnose technical problems, improve content, and allocate the resources of our systems so that your experience with our Website is as efficient as possible;
  • to process and track your transactions and to send you information about our and our group companies and business partners' products and services and other information and materials that may be of interest to you but only if you have granted us permission to do so or we are otherwise able to do so under applicable law;
  • to develop, enhance, market, sell or provide the Products or Services, or those of companies with which we have a commercial relationship, but only if you have granted us permission to do so or we are otherwise able to do so under applicable law;
  • to evaluate credit standing and to match credit bureau or credit reporting agency information; to investigate, detect and protect cityhotels.ie and other third parties against error, negligence, breach of contract, fraud, theft and other illegal activities;
  • to effect a corporate transaction, in connection with the sale, merger, spin-off, or other corporate reorganization of our corporation, where the information is provided to the new controlling entity in regular course of business;
  • to audit compliance with our policies and contractual obligations;
  • as permitted by, and to comply with, any legal or regulatory requirements or provisions; or
  • for any other purpose to which you consent.

 

25.15  Session Data

We use Session Data, collected through cookies and pixel tags, to better understand how our Website is navigated, how many visitors arrive at specific pages, the length and frequency of stays on the Website, the variety of searches of the website's database, the types of browsers and computer operating systems used by our visitors and the Internet Protocol addresses from which visitors connect to the Website. We also use this information to improve our Website content and ease of use, to personalize and improve your individual viewing experiences on our Website, and provide information that may be of interest to you.

 

25.16  Pixel Tags

We use pixel tags to monitor the open rate of our communications. This helps us understand the effectiveness of communications we send. We do not use this information for any other purpose.

 

25.17  Aggregated Information

Aggregated information is information, recorded in any form, about more than one individual, where the identity of the individual is not known, and cannot be inferred from the information. We may use aggregated information to describe our user base to current or potential partners, investors and advertisers; after a survey, to understand and respond to market needs and preferences; or to make recommendations to other users of the Website. For example, if users of the Website who have travelled to a particular destination told us that they had positive experiences at a hotel in that destination, we might recommend that hotel.

 

25.18. To whom we disclose Personal Information

From time to time, we may disclose your Personal Information to:

  • those travel service providers with which you make arrangements through the Website. We provide them with the Personal Information needed to make and complete the purchase, booking, or reservation.
  • organizations that perform services for or on our behalf for example to provide customer service, deliver tickets, ship items, process credit cards, for research, marketing, data processing, to measure the use of the Website or to facilitate usage. We will share with these companies only that Personal Information which they need to work on our behalf.
